(7) If question 6 is answered in the affirmative, may individuals of a Member State allege that the Member State has infringed Articles 8(1) and/or 9(1) of Directive 98/34, and therefore failed to fulfil its obligations, thereby giving rise to liability for damages; in other words, is that directive intended to confer rights on individuals?

As regards the second head, it is apparent from the application that the applicant has not identified the rule of law, which, in its view, has been infringed by the Commission in that it decided, in Article 2 of the contested decision, to retain the interest accrued, since provisional payment of the initial fine, by the part of the initial fine equal to the new amount of the fine fixed in Article 1(2) of that decision.

S’agissant du second grief, il ressort de la requête que la requérante n’a pas identifié la règle de droit qui, selon elle, a été violée par la Commission en ce qu’elle a décidé, à l’article 2 de la décision attaquée, de conserver les intérêts produits, depuis le paiement à titre provisoire de l’amende initiale, par la partie de cette dernière égale au nouveau montant de l’amende fixé à l’article 1er, paragraphe 2, de ladite décision.

14. The undertakings Acerinox SA, ALZ NV, British Steel plc, Krupp Stahl AG, Terni Acciai Speciali SpA, Thyssen Edelstahlwerke Ag, Ugine Aciers de Châtillon et Gueugnon, Outokumpu OY and Avesta AB have, during the years 1986, 1987 and 1988 ( January to April ), infringed Article 65 ( 1 ) of the ECSC Treaty by entering into the Agreement dated 15 April 1986 concerning quotas and prices which prevented, restricted and distorted normal competition in the common market by controlling production and by sharing markets and customers .

16. THEY PROMISE AND ENGAGE that they will, in all respects, obey and abide by the law; that they will maintain peace between each other, and between themselves and other tribes of Indians, and between themselves and others of Her Majesty's subjects, whether Indians, half-breeds or whites, this year inhabiting and hereafter to inhabit any part of the said ceded territory; and that they will not molest the person or property of any inhabitant of such ceded tract, or of any other district or country, or interfere with or trouble any person passing or travelling through the said tract or any part thereof, and that they will assist the officers of Her Majesty in bringing to justice and punishment any Indian offending against the stipulations of this Treaty or infringing the law in force in the country so ceded.
